Buying & Renting a Property in Ghana
We conduct due diligence on the ownership of the property to ensure that you are dealing with the true owner of the property, whether it is a stool, family, company or an individual. Under the new Land Act, 2019, stools and families are required to set up Customary Land Secretariats. This is why we verify the ownership of any property you wish to buy.ย
We also conduct due diligence on the property itself to ensure that you are getting what the seller says they are selling to you; the location, the amenities, fixtures & fittings, etc.ย
In addition, we review the terms of the Sale & Purchase Agreement or Conveyance to ensure that you negotiate a fair price for the property. We also ensure that there are no hidden taxes and fees that will increase your purchase price later; for example, stamp duty, ground rent, cost of getting your title registered, etc.
Furthermore, as the buyer, we prepare the Sale & Purchase Agreement or Conveyance for you. This will ensure that all the necessary terms and conditions are included in it. This is a requirement under the law because a conveyance shall only be prepared by a lawyer.
Another reason why we need to get us to represent you when buying property in Ghana as a foreigner is that, if you intend to use the property as an investment vehicle, we will prepare the necessary tenancy agreements that will suit your needs and comply with the laws of Ghana.
The most obvious reason why you should hire us is that we are experts of the law: we understand the complex real estate laws of Ghana and will guide you through the process.
We ensure you don’t miss any important steps in the property purchase process by consulting relevant government agencies and providing advice on the legality of your decision to buy property.
In addition, we can act as an intermediary between you and the seller, which can provide another layer of protection. For example, if there were any disputes about what was agreed to at a meeting or what was written in a contract, then it would be up to us to decide how best to resolve the dispute on your behalf.
Buying property in Ghana as a foreigner may seem daunting, but with legal help and extra protections, you can buy property without worry. If you want all your bases covered before purchasing property in Ghana, then be sure to hire a lawyer.
